It has never been easy for workers injured at workplaces to apply for the industrial accident compensation insurance, taking the required procedures up to the endorsement from the government industrial accident compensation insurance agency. Particularly, workers at small enterprises do not dare to apply for the insurance benefits, being fearful of the disadvantages in employment from the employers who do not want to report the industrial accidents to the government insurance agency.
The employers who run small businesses tend to opt for the private insurance coverage or compensation for the treatment of injuries on duty in order to avoid the hike of insurance premium rate and strict labor inspection at workplaces that come after they make an industrial accident report to the government insurance agency.
In recent, a life solid waste recycling company filed an administrative litigation against the Korea Workers' Compensation and Welfare Service(Kcomwel) which endorsed an application for the industrial accident compensation insurance lodged by an injured worker of the company.
If the court rules in favor the recycling company which rejects the application endorsement, the injured worker has to pay back over 10 million won(US$8,760) which he has used for the medical treatment and living to the Kcomwel.
