One in four subcontract workers in the shipbuilding industry was found to have witnessed or experienced sanctions due to the blacklist which was allegedly used by the subcontractors not to hire subcontract workers who have involved in forming trade unions or participated in the trade union activities, according to a survey conducted by the Korean Metal Workers' Union(KMWU).

The survey interviewed 926 subcontract workers in the areas of Mokpo, Ulsan, Geoje, Tongyeong and Changwon. According to the survey, 146 respondents(15.8%) have witnessed that their co-workers experienced the sanctions, 52 respondents(5.6%) said that they have witnessed other subcontract workers suffered from the sanctions, and 48 respondents (5.2%) said that they were the victims of the sanctions. A total of 246 respondents(26.5%) said that there exists a blacklist which effectively deprived the unionized subcontract workers of their employment opportunity.

KMWU said that as the use of the blacklist against unionized subcontract workers is in breach of the Labor Standards Act, Trade Union and Labor Relations Adjustment Act, and Personal Information Protection Act, it is a serious offense. Therefore, KMWU argued, a punitive compensation system for damages should be introduced not to use the blacklist and the prime contractors should be regulated not to conduct unfair labor practices.
