Since its entry to the International Labor Organization(ILO) in 1991, the Korean government has been repeatedly recommended to ratify the ILO fundamental conventions. Amid the efforts made by the Economic, Social and Labor Council(ESLC) towards the social dialogue beginning from July this year, a concrete legislative direction for the ratification of ILO core conventions was made public, first time in 27 years since South Korea became a member of the UN special agency for labor. Even though the agreement is not a consensus reached by the labor, employers and the government, it has a significant meaning that it concludes the debates regarding the right to organize through the minimum legislative requirements proposed by the public interest members of the committee.

The core legislative requirements requested in the agreement by the public interest members are to allow the dismissed and the unemployed to join the labor unions and to expand the right to organize for the civil servants and teachers. The time-off system for the activities of labor union officials is recommended to be retained and to be decided voluntarily by the labor and management. The right to organize for the workers in the special forms of employment(dependent self-employment) is passively recommended only to propose that "measures be sought for the protection in compliance with the principle of the freedom of association."

Public interest members of the Labor Relations System and Practice Improvement Committee formed by the Economic, Social and Labor Council(ESLC) made public an agreement as to the necessary requirements for the ratification of ILO core conventions on November 20, after four months of discussion procedures, whose agreement had been earlier presented to the plenary meeting of the committee on November 17.

Prof. Park Su-keun, the chair of the Labor Relations System and Practice Improvement Committee, said that "on November 17, we concluded the discussion regarding the right to organize (identified) as the minimum legislative requirement for the ratification of ILO core conventions in the 12th plenary meeting of the committee," and continued that "the agreement reached by the public interest members will be submitted to the Steering Committee of the Economic, Social and Labor Council."

The Labor Relations System and Practice Improvement Committee had been attempting to reach a tripartite consensus without success. Regarding the agenda for the discussion, the business circle demanded to include the matters of collective agreement and industrial action as well as the right to organize, whereas the labor circle wanted to discuss only the right to organize for the ratification of ILO core conventions. The public interest members of the committee came up with a revised draft which included part of the improvement measures in relation to the collective agreement and industrial action demanded by the business circle in early this month to reach a tripartite consensus, but it failed again due to the rejection of the business circle.

The Labor Relations System and Practice Improvement Committee concluded the discussion only on the right to organize with the announcement of an agreement reached by its public interest members. The committee plans to further discuss the items of collective agreement and industrial action from next month with the timeline of finishing the discussion by the end of January next year for the purpose of reaching a social consensus. Prof. Park said that "we will seek for a consensus as a matter of principle by the end of this year if circumstances allow, or at the latest by January next year we will conclude the discussion."

The agreement by the public interest members focused on the expansion of the right to organize for the ratification of the ILO Convention No. 87(Freedom of Association and Right to Organize) and Convention No. 98(Right to Organize and Collective Bargaining). It recommended the revision of the Trade Union and Labor Relations Adjustment Act in the context of guaranteeing the dismissed and the unemployed to join trade unions and their trade union activities in forming trade unions at their own free will. However, it requested to find ways that the effective operation of business should not be obstructed by the trade union activities of union members within the company, who are not employed the company.

It also recommended to amend Article 23-1 of the Trade Union and Labor Relations Adjustment Act limiting the elected union officials only to union members and to delete Article 9-2 of the Enforcement Decree of the Trade Union and Labor Relations Adjustment Act upon which the Korean Teachers and Educational Workers Union was notified as 'not regarded as a trade union' by the authority. It added, however, that the qualification for the election of union officials and representatives at the enterprise-based union needs to limit among union members employed by the company.

Prof. Park said that "the agreement (by the public interest members) is a meaningful progress, as it made clear the targets for the institutional improvement afterwards through the identification of the minimum legislative requirements for the ratification of ILO fundamental conventions," and continued that "we will do our best to reach a final consensus through the follow-up discussions."

The apex trade union organizations of the Federation of Korean Trade Unions(FKTU) and the Korean Confederation of Trade Unions(KCTU) welcomed the agreement, saying that "it took a meaningful step forward in laying a foundation stone for the guarantee of the trade union rights in relation to the ratification of ILO core conventions." and expressed the hope that "the full guarantee of basic labor rights will be realized through the expedited ratification of ILO core conventions."
